Official Rules: Rock the Garage


These are the official rules (“Official Rules”) that govern how Rock the Garage will operate (“Contest”). In

these rules, “we,” “our,” and “us” refer to Advance Stores Company, Incorporated (“Advance”), as the Sponsor of this Contest. “You” refers to you or an authorized member of your band.




1. Contest Description

Rock the Garage (the “Contest”) is a two-part online contest that will involve the public’s voting on entrants’ musical performances  to determine further consideration as  Contest winners. In order to participate in the Contest, applicants must submit videos and information, as described below (collectively, the “Entry”) to Advance in accordance with the terms and conditions specified herein (such applicants become “Participants”).


The object of this Contest is to award two prize winners from among the top publicly-voted Participants who exhibit creativity and musical inclination. All eligible Contest Entries will be posted on (the “Contest Site”) for online voting. Of the Entries receiving the most valid online votes, Advance will select 2 to receive a guitar.


2. Eligibility

To qualify as a Participant, you and each member of your band must be legal residents of the 50 United States or the District of Columbia (“DC”), be 18 years or older as of the date of entry, and  sign up at  To qualify as a voter in the Contest, you must be a legal resident of one of the 50 United States or DC and be 18 years of age or older as of the beginning of the Contest Period (defined below) (“Voter”).  Employees of Advance Stores Company, Incorporated., its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Contest Entities”), and immediate family members and/or those living in the same household of Contest Entities are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.  Although Advance may use mechanisms to verify the eligibility of Participants, voters, and Winners (defined below), Advance is under no obligation to verify the eligibility of any particular Participant, voter, or Winner or to take any corrective action as a result of such verification of eligibility.


3. Contest Period

The Contest begins at 12:01 AM ET on September 27, 2019 and ends at 11:59 PM ET on November 7, 2019 (the “Contest Period”). As set forth below, there are two periods within the Contest Period; the “Entry Period” when Entries can be submitted (); followed by the “Voting Period,” when members of the general public can vote on the entries () to determine the “Winners”.  The Entry Period begins at 12:01 AM ET on September 27, 2019 and ends at 11:59 PM ET on October 20, 2019. The Voting Period begins at 12:01 AM ET on October 24, 2019 and ends at 11:59 PM ET on November 7, 2019.


4. How to Submit an Entry

During the Entry Period, go to the Site and follow the directions to submit an entry to become a Participant in the Contest (“Entry”).  Your Entry must describe the musical band of which the Participant is a member, and must include a video of the Participant or the Participant and their band performing.  To be eligible for consideration for posting to the Site for voting, an Entry must (i) be submitted through the Site by the end of the Entry Period; and (ii) comply with these Official Rules. There is a limit of one (1) Entry per Participant and Band during the Contest Period.


All Contest Entries may be reviewed for compliance with these Official Rules; however, such review does not relieve Participant from responsibility for compliance with these Official Rules, and Participant will have sole liability for all third-party claims relating to or regarding the content of the Entry. Contest Entries that do not comply with these Official Rules or that otherwise contain prohibited or inappropriate content as determined by Advance in their sole and absolute discretion may be disqualified at any time without notice.


5. Entry Content Guidelines

Contest Entries MUST:

  • Describe your musical projects, or band
  • Include a video of a performance, in any setting, of your musical talents or band.


Contest Entries MUST NOT:

  • be inconsistent with these Official Rules;
  • suggest or encourage the taking up of arms against any person, government, or entity;
  • discriminate against, disparage, or denigrate on the basis of race, ancestry, place of origin, color, ethnic origin, citizenship, creed, sex, sexual orientation, age, record of offenses, marital status, family status, physical or mental disability, language, or any other ground prohibited by applicable legislation;
  • disparage or denigrate a product, service, person, company, or organization including, but not limited to, Advance, or any other Contest Entity;
  • promote alcohol, illegal drugs or activity, tobacco, firearms/weapons, prostitution, or pornography;
  • contain any profanities, be overtly sexual, suggest an intent to abuse, or contain suggestions of violence;
  • involve religious advocacy or proselytizing, defined as acts and intentions to advance a religious denomination or expand membership or encourage conversion;
  • prominently or intentionally feature any third-party commercial products and/or company trademarks, logos, brands, or endorsements (including but not limited to third-party logos on street scenes, panoramic views, vehicle license plates, or clothing, such as t- shirts or hats); an Entry may contain the name and trademark of your band;
  • use individuals’ names, in whole or in part, without permission; or
  • contain materials embodying the names, likenesses, photographs, or other identifying elements of any person, living or dead, without permission.


Contest Entries must: (i) be original and of Participant's own creation, and (ii) not violate the intellectual property or proprietary rights of other parties. Once submitted, an Entry will not be returned. Advance may, in its sole and absolute discretion, reject, refuse, remove, delete, and/or disqualify or disallow any Entry that the Advance, in its sole and absolute discretion, deems inappropriate or otherwise non-compliant with these Official Rules. If the Advance or any Contest Entity, at any time during the Contest Period, receives a complaint (including but not limited to a cease-and desist letter, general letter of complaint, etc.) alleging intellectual property infringement in an Entry, Advance may, in its sole and absolute discretion, remove such Entry from the Site and disqualify the Entry without prior notice to Participant.


6. Voting

Voters will be required to follow the directions on the Site in order to place a vote. Each Voter may only vote once in the Contest. Advance may share with the Contest Entities or other organizations involved with the Contest the e-mail addresses and user information of Voters. If Advance determines, in its sole and absolute discretion, that any Voter has not complied with these Official Rules in any way, then Advance has the right to disqualify any vote that such Voter has submitted and disallow any further participation or voting by such Voter.


7. Winner Selection

After the Voting Period has ended, Advance will select two (2) Entries from among those that receive the greatest number of votes as the “Winners.”


Advance may use any information, whether or not provided in the Entries, to select the Winners, and Advance's decisions regarding Winner selection shall be based solely on Advance’s discretion.


It is possible that 2 or more Entries may contain similar content. Advance is under no obligation to review or consider the similarity of other Entries in determining whether or not to accept an Entry or in determining the Winner. Advance, in their sole and absolute discretion, are final and binding in all matters relating to the Contest.


Advance will require a Winner to complete winner documents as a condition to receiving any the Prize and to avoid disqualification as a Winner. No substitution of a Prize is offered, except at the sole and absolute discretion of Advance. Any prize is non-transferable. Neither Advance nor any other Contest Entity is responsible for a lost or stolen Prize.


8. Prizes

Each winner of the Contest (the “Winner”) will receive 1 guitar valued at $300. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Advance. No cash or other prize substitution shall be permitted except at Advance’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. Acceptance of prize constitutes permission for Advance to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.


9. Taxes

There may be some tax implications for the Winner(s). If there is any tax liability, it will be the sole responsibility of the Winner(s).


10. Grant of Rights to Advance

Submission of an Entry constitutes Participant’s certification that the Entry is Participant’s own original work and Participant represents and warrants that the Entry does not and will not infringe the intellectual property or proprietary rights of any third party, including, without limitation, any third-party patents, copyrights, or trademarks. By submitting an Entry, Participant hereby irrevocably grants Advance, and its respective successors and assigns an irrevocable, perpetual, worldwide, non-exclusive, royalty- free, sub-licensable (through multiple tiers), and transferable license and right to use, copy, transmit, or otherwise distribute, perform, modify, create derivative works based upon, incorporate into other works, publicly perform, and display the Entry or any portion thereof, in or through any medium, whether now known or hereafter created.


Nothing herein will constitute an employment, joint venture, or partnership relationship between Participant and Advance. Participant also irrevocably grants Advance, and its respective successors and assigns, where not prohibited by law, an irrevocable, perpetual, worldwide, non- exclusive, royalty-free, sub-licensable (through multiple tiers), and transferable license and right to use the name,  voice, likeness, and biographical material of Participant or (if Participant is a group or organization) members of Participant, in any merchandising, advertising, marketing, promotion, press releases, social media, or any other purpose related to the Entry and/or Contest or in any other way Advance or any other Contest Entity deems appropriate. Participant acknowledges that Participant has no right of approval or consultation with respect to the Advance or any other Contest Entity's use of the Entry or the licenses and rights granted above.


11. Winner Notification

Potential winner will be notified on or about November 13, 2019, by Advance via telephone, and/or email, in Administrator’s sole discretion, and must execute and return an affidavit of eligibility, a liability/publicity release, and any other documents required by Advance and, where not prohibited by applicable law, within days (3) days of date of issuance specified in the notice or prize will be forfeited. If the winner is at least 18 years of age but considered a minor in his/her jurisdiction of residence, such minor’s parent or legal guardian must execute the liability/publicity release on minor’s behalf. Failure to return the documents listed above or reply to the email and/or phone call with the requested information, within the specified time-period, the return of a notification as undeliverable, noncompliance with these Official Rules, or Advance’s inability to contact the potential winner within a reasonable time-period may result in forfeiture of potential winning status and the random selection of an alternate winner at Advance’s discretion. No messages will be left on answering machines or voice mail systems. Administrator is not responsible for technical difficulties with telecommunications systems beyond its control.

If a Winner (or a Winner’s parent or guardian, as applicable) is unwilling or unable to sign and return any document listed above within the specified time period, to provide any item set forth in any document listed above within the specified time period, or to otherwise timely comply with these Official Rules, then Advance may void that Winner’s eligibility as a Winner (with such Winner forfeiting any Prize). In such case, Advance will not have any further obligation to that Winner or to otherwise award any Prize, but Advance may, in its sole and absolute discretion, choose an alternate Winner using the same selection method as used to select the forfeited Winner.


12. Terms and Conditions

By participating in the Sweepstakes, entrants agree to abide by and be bound by the Official Rules, Advance’s Privacy Policy ( and by the decisions of Advance, which shall be final and binding in all respects. By entering the Contest, Participants agree: (a) that Released Parties (defined below) will have no liability whatsoever for any injuries, losses, harm, damage, cost, or expense, including, without limitation, any personal injury, arising from or in connection with participation in the Contest; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. If you are selected as the winner, your information may be included in a publicly-available winners list. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST OR WEBSITE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH ENTRANT AND SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. By accepting the prize, winner agrees to release Sponsor, its respective parent companies, affiliates, subsidiaries, distributors and each of their respective shareholders, directors, officers, employees and agencies (the “Released Parties”) from any and all liability whatsoever for any injuries, losses, harm, damage, cost, and/or expenses whatsoever (including without limitation, all attorneys’ fees and court costs incurred) arising from or in connection with participation in the Contest, the awarding, receipt, possession, use, or misuse of the prize, or participation in any prize-related activity including any travel related thereto. Acceptance of the prize will further constitute and signify the winner’s (or his/her parent/legal guardian if 18 but considered a minor in their jurisdiction of residence) agreement and consent that Advance and/or Advance’s assignees may use the winner’s name, likeness and/or prize and biographical information in any media worldwide without limitation for promotional purposes without further compensation. If, for any reason, the Contest is not capable of running as planned by any cause, including fraud, computer virus and electronic, network, computer or other technical malfunctions, which, in the sole opinion of Advance, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Advance reserves the right, at its sole discretion to cancel, terminate, modify or suspend the Contest and, if terminated, at Advance’s discretion, to select the winner in a random drawing from among all eligible, non-suspect entries received up to time of such action or as otherwise deemed fair and equitable by Advance. If due to a production or other error, more than 2 winners are identified, prize will be awarded in a random drawing from all such claims received.


13. Governing Law

By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor with respect to the Contest, shall be governed by, and construed in accordance with, the laws of State of  North Carolina without giving effect to any choice of law or conflict of law rules.  By entering, Participants consent to the jurisdiction and venue of the federal, state and local courts located in Raleigh, North Carolina. In the event of any discrepancy or inconsistency between these Official Rules and disclosures or other statements contained in any Sweepstakes-related materials or made by any representative of Sponsor, these Official Rules shall prevail, govern and control.


14. Severability

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.


15. Name of Winner

For the name of the winner, available after November 16, 2019, send a self-addressed, business-size envelope with proper postage affixed by December 21, 2019 to: Rock the Garage Contest, Attn: Advance Auto Parts Marketing, 2635 E. Millbrook Rd., Raleigh, NC 27604
